1. Acceptance of Terms

By downloading, installing, or using Herbalion ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Herbalion is an educational herbal encyclopedia providing general botanical and traditional-use information about medicinal plants. The App also offers AI-powered herb consultation features for informational purposes only.

3. User Accounts

• You may create a free account using your email address or Google Sign-In.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Tier & Premium Access

• Free users receive 3 AI consultations per day at no charge.
• Premium access is available via one-time payments for defined time periods.
• All payments are processed securely by Stripe. We do not store payment card data.
• Payments are non-refundable except where required by applicable law.
• Premium access activates immediately after successful payment confirmation.

5. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations.
• Attempt to reverse-engineer, scrape, or extract data from the App.
• Use automated tools to abuse the AI consultation feature.
• Share, resell, or redistribute premium access to third parties.
• Impersonate another person or entity.

6. Intellectual Property

All content, design, code, and branding in Herbalion is owned by or licensed to Herbalion. Herb photos are sourced from iNaturalist (CC-licensed) and botanical illustrations from Wikimedia Commons (public domain / CC-licensed). You may not reproduce or redistribute App content without written permission.

7. AI Consultation Disclaimer

AI-generated herb recommendations are for educational and informational purposes only. They are not a substitute for professional medical advice. Herbalion makes no warranty regarding the accuracy, completeness, or fitness for any particular purpose of AI-generated content. Use of AI consultation results is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Herbalion and its owner shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to health outcomes from herbal use, data loss, or service interruption.

9. Indemnification

You agree to indemnify and hold harmless Herbalion and its owner from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date above.

11. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of the Czech Republic, unless otherwise required by applicable consumer protection law in your jurisdiction.

1. About Herbalion

Herbalion ("we," "our," or "the app") is an educational herbal encyclopedia for the United States market. We provide general botanical and traditional-use information about medicinal plants.

2. Information We Collect

We collect the following information when you use Herbalion:

• Account data: Email address and display name when you create an account or sign in with Google.
• Usage data: Number of AI consultations per day (for rate limiting — maximum 3 free consultations per day). This counter resets every 24 hours.
• Saved data: Herb consultations and harvest planner entries you choose to save, stored in your account.
• Device data: We do not collect device identifiers, location data, or browsing history.

3. How We Use Your Information

• To provide and sync your saved consultations across devices.
• To enforce daily consultation limits (free tier).
• To send harvest reminder notifications if you enable them.
• We do not sell, rent, or share your personal information with third parties for marketing purposes.

4. Third-Party Services

Herbalion uses the following third-party services, each with their own privacy policies:

• Google Firebase — Authentication and data storage. firebase.google.com/support/privacy
• Anthropic Claude API (via Cloudflare Workers) — Powers AI herb consultations. Consultation text is sent to Anthropic for processing. anthropic.com/privacy
• iNaturalist — Herb photos (CC-licensed, loaded from their servers). inaturalist.org/privacy
• Wikimedia Commons — Botanical illustrations (public domain / CC-licensed). wikimedia.org/privacy
• Stripe — Payment processing for Premium subscriptions. We do not store card data. stripe.com/privacy

4b. Advertising

Herbalion displays ads to support free access. Google AdSense may use cookies to show relevant ads. You can opt out at google.com/settings/ads. Affiliate links are marked "AD".

5. AI Consultation Data

When you use the AI consultation feature, the health information you enter (symptoms, medications, conditions) is sent to Anthropic's API to generate a response. We do not store your health intake data on our servers. Anthropic may retain API request data per their own privacy policy. Do not enter sensitive personal health information you are not comfortable sharing with a third-party AI service.

6. Children's Privacy

Herbalion is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us.

7. Data Retention & Deletion

Your saved consultations and account data are retained until you delete your account. To delete your account and all associated data, contact us at the email below. We will process deletion requests within 30 days.

8. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the app after changes constitutes acceptance of the updated policy.
